1. About These Terms
These terms form the basis of our contract with you. By ordering from us you agree to these terms, except where other terms have been expressly agreed in writing between all parties. Other documents (see: privacy policy) also form part of these terms and you are strongly encouraged to review them.
2. Ordering and Acceptance
When the buyer completes the process of placing an order, the seller will send the buyer an email confirming receipt and details of the order. The order represents an offer to purchase the items from the seller and is accepted by the seller at the point where items are dispatched for delivery. If more than one item has been ordered at the same time, the dispatch of one item does not indicate the acceptance of an offer to purchase another. The seller reserves the right to cancel orders prior to acceptance. The buyer is responsible for ensuring that they order the correct items and that their contact and address details are correct. If additional costs are incurred as the result of a mistake on the part of the buyer during ordering, the buyer will cover such costs.
3. Payment
The buyer agrees to pay the price stated at the time of ordering. Usually payment will occur in advance of the goods being dispatched. In the case where the buyer has received goods which have not been paid for, the buyer shall pay the seller on demand. In the event a buyer is overcharged for an order the seller will refund the difference as soon as the seller is made aware of the error. In the event the buyer is under charged, the buyer must pay the difference on request from the seller.
4. Pricing and Availability
The seller reserves the right to vary, at any time, any price advertised on this website, literature or elsewhere. Goods are supplied at the price prevailing as at the date of the offer made by the buyer. All prices are inclusive of VAT except where expressly stated otherwise. While every effort is taken to ensure accurate stock indications, no guarantee is given as to the availability of any item at the time of ordering. If an item ordered which is out of stock, the seller will contact the buyer to discuss any delay, alternative items or cancellation.
5. Delivery
The seller uses a variety of delivery methods depending on the items ordered, the service selected by the buyer and the destination. The following conditions apply to all deliveries.

Standard delivery is not a guaranteed service, items will be dispatched as soon as possible but no date or time for delivery is promised by the seller.

For services where an agreed delivery date or time has been given, the seller will use a courier service to meet those guarantees. In the event the courier fails to deliver as promised, any delivery charges paid by the buyer will be refunded on request. If the buyer places an order which cannot be dispatched in time for the chosen date, the seller will contact the buyer to inform them.

Cut off times apply for placing orders for guaranteed delivery services. Please see published information, which may vary from time to time.

For particularly large or bulky items, specialist delivery services may be used. If this is the case, the seller will contact the buyer to arrange delivery.

Where an order contains custom or made to order items, or the item requires specialist delivery, the seller can only provide an estimated delivery window, no guarantees can be provided for these orders.
- Where a payment made by the buyer has not cleared or where additional security checks are required due to incorrect or incomplete information from the buyer, dispatch may be delayed. Where the buyer opts to apply for credit, items cannot be dispatched until their application is verified and any identity documents requested have been validated.
If any delivery or other service is delayed by any cause beyond the reasonable control of the seller or their appointed third party (for example, severe weather, customs delays etc), a reasonable extension of time shall be granted by the buyer, this includes any reasonable extension to a guaranteed delivery date.
6. Loss or Damage in Transit and Incorrect Items
In the event an item arrives to the buyer damaged or the item is incorrect, the buyer will inform the seller as soon as possible and within seven days of receipt. Claims for damage or incorrect items beyond the seven day period cannot be accepted by the seller. The seller will arrange for a replacement, refund and/or collection of the item as the seller deems necessary.
Where an item which is dispatched does not arrive within a reasonable time the buyer must inform the seller within one month of the expected delivery date. Claims for lost items beyond the one month period cannot be accepted by the seller. The seller will replace the item or refund the buyer as the seller deems necessary. In the event of loss or damage to a delivery, the buyer provide any information requested by the seller or a third party.
7. Returns
The buyers right to return goods and the timescales in which they can do so, vary dependent on the reason for return and the method of purchase.
7.1 Damaged or Incorrect Items
See section 6.
7.2 Defective Items
If an item arrives defective, or develops a fault within 30 days of receipt, the seller will replace the item with a new one (see section 7.4). After this period the seller will repair or replace goods as deemed appropriate by the seller, up to the time limit specified by the manufacturer's warranty. For damaged or defective items (within 30 days) the seller will collect the goods from the buyer, or with prior agreement, will refund the buyers shipping costs. The seller will not collect any item for which the original packaging has been disposed of, or is damaged beyond use. In this case, the buyer must return the item to the seller themselves. After 30 days, the buyer will cover the costs of returning an item and the seller will cover the costs of returning the item to the buyer. If the buyer returns an item which when tested is found not to be defective, or has been damaged by the buyer, the buyer will cover the costs of repairs, if still required, and any other costs incurred, such as collecting from and shipping back to the buyer.
7.3 Unwanted Items
This section does not apply to purchases for businesses or to purchases made in person. The buyer may cancel the contract and receive a full refund within seven days of receipt, given the following conditions.

The buyer is responsible for the safe return of the items to the seller, any damage or loss may be deducted from the refund due.

Returns must include all original packaging, all manuals, cables, accessories etc and any included items, such as bundled products. Any missing components may be deducted from the refund due.

Some items are excluded from this right, specifically custom made goods, such as made to order cables.

The buyer will cover all costs involved in shipping the item back to the seller, including insurance and tracking services as appropriate.
7.4 Alternative Items as Replacements
If a replacement item is required and the seller is unable to source one, the seller may offer suitable alternative items to the buyer as a replacement. The value of any alternative item will not be less than that of the price paid for the original.
7.5 Warranties
Where a manufacturer offers a warranty repair service the buyer will be expected to comply with any reasonable instructions from the manufacturer to facilitate the required work.
It is the responsibility of the buyer to adhere to the terms of any warranty in place. Any breach of the warranty terms which renders a warranty void, such as the modification or export of an item, may result in a rejected claim for repair and a liability for additional costs for the buyer.
8. Customs and Exporting Goods
If the buyer orders for delivery overseas they may be subject to import duties and taxes, which will be charged by the relevant authorities. The buyer takes full responsibility for anticipating and paying such charges and taxes. Items opened or damaged by customs are the responsibility of the buyer and it is up to the buyer to seek recompense from the appropriate authority in these circumstances. The seller cannot offer advice on customs issues or tax related claims, such as recovering VAT on exports. It is the responsibility of the buyer to claim back any such taxes as they are permitted to from the relevant authority.
9. Accuracy of Information and Discrepancy
Whilst the seller makes every effort to ensure the accuracy of the information shown in descriptions, the seller can accept no liability for damages or injury arising directly or indirectly from any error or omission in such information. The photographs, dimensions, specifications and type numbers provided are shown only as a guide, and although the seller will usually supply the exact product shown, they reserve the right on occasions to supply similar to items but of minor detail differences, after first contacting the buyer to discuss the alternative. The buyer will inspect the goods on arrival and if they do not correspond in nature to the goods ordered, will give the seller written notification of any discrepancy within seven days of the despatch, failing which the buyer shall be deemed to have accepted the goods.
10. Defective Goods and Consequential Loss
The seller guarantees that the goods are free from defects and are of satisfactory quality but it is for the buyer to satisfy themselves that the goods are fit and suitable for purpose. Defects in goods delivered shall not be grounds for cancellation by the buyer of the remainder of any order or contract.
It is expressly agreed and understood by the buyer that the seller’s liability in respect of defective or otherwise unsatisfactory goods shall under no circumstances whatsoever extend beyond the price paid for such goods, in particular the seller shall not be liable for any damage to property, nor any consequential loss of whatsoever nature, however caused, arising out of any defect in the goods, or from their failure to correspond to any description or representation, or from their unsuitability for any purpose.
If any buyer alleges that goods supplied are defective the buyer will return them, carriage paid, to the seller's premises. If after examination by the seller, it is established that the goods are defective then the seller will refund the buyer the cost of the carriage and replace the goods or at the seller’s absolute discretion refund the original purchase price.
If the buyer does not inform the seller of such rejection within a reasonable time, the buyer will be deemed to have accepted the goods.
11. Applicable Law and Jurisdiction
The contract is subject to English Law. |
